10. Dispute Resolution

• Informal Resolution
  • Before filing a claim against Strategy of Finance, you agree to try to resolve the dispute informally by contacting Hello@StrategyofFinance.com. Strategy of Finance will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 180 days after submission, you or Strategy of Finance may bring a formal proceeding.
• Arbitration Agreement
  • You and Strategy of Finance agree to resolve any claims relating to these Terms or the website through final and binding arbitration, except as set forth under Exceptions to Agreement to Arbitrate below.
  • The arbitration will be conducted in India, unless you and Strategy of Finance agree otherwise. Each party will be responsible for paying any filing, administrative, and arbitrator fees according to applicable rules.
  • The arbitration will be conducted in the English language, but any witness whose native language is not English may give testimony in their native language, with simultaneous translation into English (at the expense of the party presenting the witness).
• Exceptions to Agreement to Arbitrate
  • Either you or Strategy of Finance may assert claims, if they qualify, in small claims court.
  • Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the website or intellectual property infringement without first engaging in arbitration or the informal dispute-resolution process described above.
• No Class Actions
  • You may only resolve disputes with Strategy of Finance on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.
• Judicial Forum for Disputes
  • In the event that the agreement to arbitrate is found not to apply to you or your claim, you and Strategy of Finance agree that any judicial proceeding will be brought in the federal or state courts of Mumbai, India. Both you and Strategy of Finance consent to venue and personal jurisdiction there.
